All content published and made available on our Site is the property of Fit Eat and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site. Fit Eat declares to own the copyright licenses to all those digital assets accessible on the Site.

 

3. Site Accounts

 

When you create an account on our Site, you agree to the following:

 

You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

 

All personal information you provide to us through your account is up to date, accurate and truthful and that you will update your personal information if it changes.

 

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

 

 

4. Sale of Goods

These Terms and Conditions govern the sale of goods available on our Site.

The only Good(s) that are sold on this site are fresh, pre-cooked diatery meals. However, we reserve the right to sell other goods alongside appropriate to Fit Eat's goods as required. Upon the purchase of the goods, the person who consumes Fit Eat's goods becomes a "Customer." This definition does not transfer to any third parties that have consumed the goods via Customer's unregistered redistribution of Fit Eat's goods.

We are under a legal duty to supply goods that match the description of the Good(s) you order on our Site, with the exception of Clause 6. Alterations of Good's ingredients.

These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

 

5. Food Allergies

 

If the Customer is aware of any food allergies that affect their dietary requirements, it is the Customer's responsibility to inform the Company at the point, or within 24 hours of the purchase of Goods to allow the Company to conduct a dietary consultation prior to delivering the Goods. The contact can be made via e-mail, phone, or Website's chat feature.

If the Customer receives goods without declaring their allergies and the Company acknowledging the Customer's dietary requirement, Fit Eat holds no legal liability for medical expenses or health deterioration caused by the Customer's negligence.

The Customer is prohibited from placing an order knowing that the Customer has allergies, without contacting the Fit Eat team to accommodate for this dietary requirement.

 

6. Food Poisoning

 

"Food Poisoning" may be defined as "an accurate illness" caused by eating contaminated or poisonous food. The symptoms usually include vomitting, diarrhoea and abdominal pain, usually lasting up to 48 hours after consumtpion of such food.

Fit Eat ensures that the food prepared as the "Goods" is fresh and is prepared in a sanitary conditions that are adhering to the key regulations outlined by the Food Standards Agency Act 1999, Food Safety Act 1990 and The Food Safety Order 1991.

As such, Fit Eat holds no responsibility to any sickness that may be caused by what the Customer eats outside of the recommended diet of Ft Eat. The company holds no responsibility if a Customer experiences food posioning, as Fit Eat has no control over what a Customer eats outside of the diet of Fit Eat.

Furthermore, Fit Eat does not take any responsibility for medical emergencies that may or may not be caused by the consumption of pits, nuts and any harder food ingredient. For example, in an event where a customer breaks their tooth during the good's consumption, Fit Eat is not responsible for the way or method the Customer consumes Company's products. It is the Consumer's responsibility to eat carefully and in a sensible manner.

Although The Company upkeeps the highest standard of service with the top score of Food Hygine Rating, there may still might be a possibility of traces of foreign bodies (e.g. stones, seeds or traces of allergens) occurring within the meals. In an event that this scenario happens, please contact us at info@fiteat.uk for further investigation. See points 11. Returns and 15. Dispute resolution for the correct grievance procedure. 

 

7. Alterations to Good's ingredients

The Company reserves the right to replace any ingredient with a similar ingredient in the goods that's considered to be of similar caloric and nutritional value of the product advertised. This can happen due to product shortages. In such cases, Fit Eat will show best effort to inform the customer of any ingredient substitutions prior to the delivery of the Goods, taking into account any dietary requirements (including, but not excluding gluten, lactose, eggs, fish and/or red meat).) declared prior to and within 24 hours of the purchase, but prior to the delivery of the goods.

 

8. Customer's choice of dietary Goods.

Fit Eat is not responsible for the type of diet that the Consumer's selects at the point of purchase. Although Fit Eat can provide recommendations, it is best to contact a dietician to ensure the correct diet for the Consumer's lifestyle. Fit Eat reserves the right to advise the Consumer to the best of the Company's abilities based on the information provided by the Consumer; this is not a personally tailored diet. To prevent sick health, the customer is advised to consult with a doctor to ensure the chosen diet is the right choice for them and doesn't impose any health risks.

As such, Fit Eat does not take any responsibility for Consumer's ill wellbeing such as fainting due to selecting a too low-calorie diet from the Company's goods.

Fit Eat does not promise the consumers to loose weight unless they strictly stick to the dietary plans. Any "cheat" days invalidate the advertised results. The best way to loose weight is via a healthy mix of proper diet and exercise. Fit Eat recommends to follow the advice of the Consumer's general practice doctor or a qualified dietician.

 

9. Subscriptions

You agree to receive a phone call, text message or email from us regarding the extension of your diet for another period. Alternatively, you can extend your diet by making another order through our e-commerce store.

10. Payments

We accept the following payment methods on our Site:

 

Credit Card;

Debit Card;

PayPal;

Direct Bank Transfer;

Cash;

 

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

 

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

 

11. Returns

If you are a customer living in the United Kingdom or the European Union you have the right to cancel your contract to purchase goods from us within 14 days without giving notice. 

 

The cancellation period:

 

Will end 14 days from when you receive, or someone you nominate receives, the goods when you purchased Good(s) in one order that are all delivered together;

 

Will end 14 days from when you receive, or someone you nominate receives, the last good when you purchased goods in one order that are delivered separately; or

 

Will end 14 days from when you receive, or someone you nominate receives, the first good when you purchased goods that will be regularly delivered during a defined period of time.

 

To exercise your right to cancel you must inform us of your decision to cancel within the cancellation period. To cancel, contact us by email at info@fiteat.uk or by post at 7-11 Minerva Road, Alpha Business Centre Unit B20 NW10 6HJ. You may use a copy of the Cancellation Form, found at the end of these Terms and Conditions, but you are not required to do so.

 

Conditions of Returns:

The Consumer must document the reason for return with a photo or video of the product (the "Evidence") they wish to return prior to returning the Goods. The Evidence must be sent digitally to info@fiteat.uk. The Company is bound to respond to return claims within 7 days.

 

Any videos that are too large in file size to send, must be uploaded to a private video sharing service such as Google Drive, YouTube (private video), Dropbox or We Transfer. Failure to submit a video or setting its publicity to private may invalidate the return.

 

Each return case submitted by the Consumer will be evaluated on an individual case basis.

 

Following the Company's decision to return the product, if approved, Fit Eat will transfer the money back to the Consumer using their preferred payment method listed in Section 10. Payments.

 

The customer is responsible for the cost of returning the Goods. Fit Eat is not responsible for any damage or loss to the Goods that occurs before they are returned to the company, including while the Goods are in transit.

 

12. Shipping and Delivery

 

When you purchase goods from our Site, the goods will be delivered through our couriers. The Company is not responsible for any stolen packages after the point of delivery.

 

Delivery will take place on selected by customer date.

 

Fit Eat's designated delivery drivers aim to deliver the Goods between 4 pm and 10 pm. We reserve the right to alter this time up to 24 hours which may be caused by traffic conditions, reduced number of couriers or any other unforeseen circumstances.

 

13. Consumer Protection Law

 

Where the Sale of Goods Act 1979, the Consumer Rights Act 2015, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

 

14. Indemnity & Applicable Law

 

Except where prohibited by law, by using this Site you indemnify and hold harmless Fit Eat and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

 

These Terms and Conditions are governed by the laws of the Country of England.

 

15. Dispute Resolution

 

Subject to any exceptions specified in these Terms and Conditions, if you and Fit Eat are unable to resolve any dispute through informal discussion, then you and Fit Eat agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both the Customer and Fit Eat.

 

Notwithstanding any other provision in these Terms and Conditions, you and Fit Eat agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

 

16. Severability

 

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

 

17. Electronic Communications

 

When you visit the Site or send emails to us, you are communicating with us electronically and thereby consent to receive communications from us electronically. The primary form of electronic communication will be via email. We will communicate with you by posting notices on this site or by sending you emails.
